Clickshed Terms & Conditions

Welcome to Clickshed. These Terms & Conditions (“Terms”) govern your use of Clickshed’s website building, social-media scheduling and lead-management services (“Services”). By subscribing or accessing the Services, you agree to be bound by these Terms. If you do not agree, please do not subscribe or use the Services.
1. Definitions
- “Client”, “you” or “your” means the subscriber tradie or business using our Services.
- “Clickshed”, “we”, “us” or “our” means Clickshed, a trading name of YEAH ENTERPRISES Trust (ABN 91 848 220 932).
- “Services” means the provision of website hosting, design templates, social-media post generation and scheduling, lead-management dashboard, and related support as described on our site.
- “Content” means any text, images, data or materials you upload, generate or publish via the Services.
2. Subscription & Fees
- Subscription Plan
- You subscribe to our Services on a recurring monthly basis at the published rate (currently AUD 99/month).
- Payment
- All fees are billed in advance via your chosen payment method (Stripe). You authorise Clickshed to charge your card each month.
- Price Changes
- We may increase subscription fees, but will give you at least 30 days’ written notice before the next billing cycle.
3. Cancellations & Refunds
- No Lock-in
- You may cancel at any time via your dashboard with 30 days’ notice.
- Site Deactivation
- After your final billing cycle, your live site will be taken offline. You may export your lead data before cancellation.
- No Refunds
- All payments are non-refundable, including unused portions.
4. Hosting & Content Liability
- Hosted Platform
- All sites remain on Clickshed’s managed infrastructure and cannot be migrated off.
- Content Responsibility
- You are solely responsible for all Content you publish. You warrant that you hold all necessary rights, licences and permissions for your Content and that it complies with applicable laws.
5. Intellectual Property
- Your Content
- You retain full ownership of your Content, subject to the licence below.
- Service Licence
- You grant Clickshed a worldwide, royalty-free licence to host, copy, distribute and display your Content solely to provide the Services.
- Our IP
- All trademarks, logos, templates, software and documentation provided by Clickshed remain our exclusive property.
6. Service Availability & Support
- Uptime
- We aim for 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows may occur with prior notice.
- Support
- Email and in-app chat support are available Mon–Fri, 9 am–5 pm AEST. Response time within 24 hours.
7. Warranties & Disclaimers
- No Professional Advice
- We provide software tools only. We do not guarantee marketing results, leads or sales.
- As-Is
- Services and all content are provided “as-is” and “as-available,” without warranties of any kind, express or implied, including merchantability, fitness for purpose or non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, Clickshed and its officers, employees and agents shall not be liable for:
- Any loss of profit, revenue, data or business opportunity;
- Any indirect, incidental, special or consequential loss;
- Any losses arising from third-party integrations, downtime or Force Majeure events.
Our total aggregate liability under or in connection with these Terms shall not exceed the fees paid by you in the 6 months preceding the claim.
9. Indemnification
You agree to indemnify, defend and hold harmless Clickshed from any claim, demand or damage, including legal fees, arising out of your breach of these Terms or your use of the Services.
10. Privacy & Data Protection
Our Privacy Policy (link) sets out how we collect, use and store your personal information. By using our Services, you consent to that Policy.
11. Changes to Terms
We may update these Terms at any time. Material changes will be communicated to you at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts in Adelaide.
13. Copyright Infringement & Takedown
- Notice: If Clickshed receives proper written notice that Content on our platform infringes copyright, we may immediately remove or disable access to that material.
- Counter-Notice: The uploader may submit a counter-notice if they believe the removal was in error; Clickshed will follow applicable statutory procedures.
- Repeat Infringers: Accounts that repeatedly upload infringing Content may be suspended or terminated.
- Liability: You remain fully responsible for any infringement and agree to indemnify and hold Clickshed harmless for all resulting claims, damages and costs.
